Version 1 · Effective October 15, 2026
Initial version of the Terms of Service.
1. Acceptance of Terms
By accessing or using the PyroApex Pro website and services, you agree to be bound by these Terms of Service. Please review these terms carefully before making any purchase. If you do not agree to these terms, you must not use this website or place any orders.
2. Eligibility
You must be at least 18 years of age to purchase fireworks from PyroApex Pro. By placing an order, you represent and warrant that you are 18 years of age or older. We reserve the right to require age verification at checkout and/or at the time of delivery.
3. Products and Compliance
All products sold through PyroApex Pro comply with Consumer Product Safety Commission (CPSC) standards as set forth in 16 C.F.R. Part 1507. All fireworks products carry the required cautionary labeling in accordance with 16 C.F.R. § 1500.14(b)(7). We do not sell any items that have been banned by the CPSC.
4. State Legality and Geographic Responsibility
All merchandise is sold and shipped on the representation of the buyer that the merchandise will be used in accordance with the laws of the state, city, and county of destination. It is the purchaser's sole responsibility to confirm compliance with all applicable local, state, and federal laws regarding the possession, transportation, storage, sale, and use of fireworks before placing an order. We assume no liability for misuse, illegal sale, or transportation by the customer. We are not responsible for fireworks items seized by authorities in locations where they are not permitted.
5. Permits and Licenses
It is the purchaser's sole responsibility to obtain any and all permits, licenses, or other authorizations required for the purchase, possession, transportation, storage, sale, or use of fireworks in your jurisdiction. The presence of any product on this website does not constitute a representation that such product is legal in the buyer's location.
6. Hazmat Shipping
Fireworks are classified as Division 1.4G explosives under the U.S. Department of Transportation (DOT) regulations (49 CFR). As such, the following shipping restrictions apply:
- All fireworks shipments are transported only via licensed hazmat freight carriers
- An adult aged 18 or older must be present to sign for delivery
- Delivery to PO boxes is not available
- Minimum freight charges may apply
- The following carriers are prohibited from shipping fireworks: USPS, UPS, FedEx Ground/Home Delivery, and DHL
7. Pricing and Payment
- All prices are listed in U.S. Dollars (USD)
- We reserve the right to correct pricing errors and to refuse or cancel any orders placed at an incorrect price
- Sales tax is calculated on a destination basis for retail customers; wholesale customers are exempt with proper documentation
- A binding contract is formed upon shipment of your order, not upon order placement
8. Returns and Refunds
ALL SALES ARE FINAL.
Due to DOT hazmat classification, fireworks cannot be returned under any circumstances. No refunds or exchanges will be issued.
Exception for damaged goods: Any damage must be documented on the Bill of Lading with the driver present before signing for delivery. Photographic evidence is required. All damage claims must be reported within 10 days of delivery.
Refused shipments: If a shipment is refused by the recipient, the customer is responsible for all return freight charges plus a 15% restocking fee.
9. Wholesale Account Terms
- Licensed dealers must provide valid state and local permits to establish a wholesale account
- Wholesale customers must maintain current licensing at all times
- Customers must notify PyroApex Pro immediately of any changes to their license status
- Accounts may be terminated for non-compliance with licensing requirements
10. User Accounts

AI Assistant Terms
Version 2026-09-26. Effective September 26, 2026.
These terms supplement the PyroApex Pro Terms of Service for the tenant business and its authorized members using the AI assistant provided by Digital Drywood LLC. They govern assistant answers, credits, and confirmed changes. They do not govern purchases of fireworks from a tenant storefront. If these terms conflict with the general Terms of Service about the assistant, these terms control.
Answers and your responsibility
Answers can be wrong, incomplete, or out of date, even when they sound confident. The assistant does not provide legal, tax, or compliance advice. Verify answers against your records and consult qualified professionals as appropriate. The tenant is responsible for its business decisions and for every change its members confirm, including checking the proposed values and affected records before confirming.
Acceptable use
Use the assistant only for lawful business purposes and with data you are authorized to provide. Do not use it to engage in fraud, violate others' rights, access another tenant's information, bypass permissions or usage limits, or interfere with the service. Never enter dates of birth, identification numbers, or payment data in chat. We may suspend assistant access for misuse.
Assistant credits
Purchased credits pay for assistant usage, are non-refundable except where required by law, and do not expire. Credits are not a promise of a fixed number of answers. Purchase prices and usage rates may change after advance notice to the tenant through the service or email; the notice will state the new rates and their effective date. New rates apply prospectively. Any free allowance is separate from purchased credits.
Warranty and limitation of liability
The assistant is provided as available and without warranties of accuracy, completeness, fitness for a particular purpose, or uninterrupted availability, to the extent permitted by law. To that extent, Digital Drywood LLC is not liable for indirect, incidental, special, consequential, or punitive damages from assistant use, including lost profits or business interruption. Its aggregate liability for assistant-related claims is limited to the amount the tenant paid for assistant usage in the twelve months preceding the event giving rise to the claim. Nothing excludes liability or rights that applicable law does not allow to be excluded.
Data and chat history
Each member's chats are saved and searchable until that member deletes them by default. Only the member can view their chats; tenant administrators cannot read another member's history. A tenant administrator may instead set automatic deletion after 1 year, 180 days, 90 days, or 30 days. Members may delete one chat or all their chats.
Deleted or expired chats are removed from the database within 30 days, excluding backups. Chats belonging to a member removed from the tenant are deleted after 30 days. Chat content is never sent to application logs or Sentry. Deleting chats does not delete billing usage records, which contain no chat text, or undo confirmed business changes and their audit records. These chat-specific periods take precedence over the general account-data retention periods.
The AI privacy addendum describes the data sent to OpenAI and its retention. Questions about these terms may be sent to info@pyroapex.pro.
Opt-in terms for assistant changes
Version 2026-09-26. Effective September 26, 2026. Separate tenant-admin acceptance is required before enabling assistant changes. Reading these terms, accepting general terms, or continuing to use the service does not enable changes.
By opting in on behalf of the tenant, I confirm that I am an administrator authorized to manage its settings and bind the business. I accept this version of the assistant-change terms for this tenant. I understand that answers and proposed changes can be wrong, and that the tenant is responsible for each change its members confirm.
Opt-in permits the assistant to propose changes; it is not blanket permission to execute them. Each proposal must identify the change and affected records and requires a member's explicit confirmation. Canceling does not apply the change. The member's existing permissions still apply. Confirmed changes are recorded in the audit trail with their assistant source and conversation reference.
An authorized administrator may turn assistant changes off for the tenant. This stops future assistant changes but does not undo confirmed changes or erase audit records. Consent records identify the tenant, accepting administrator, document version, and acceptance time. A revised change-consent version requires fresh administrator acceptance before changes are enabled under that version.
