1. Acceptance of Terms

By accessing or using the PyroApex Pro website and services, you agree to be bound by these Terms of Service. Please review these terms carefully before making any purchase. If you do not agree to these terms, you must not use this website or place any orders.

2. Eligibility

You must be at least 18 years of age to purchase fireworks from PyroApex Pro. By placing an order, you represent and warrant that you are 18 years of age or older. We reserve the right to require age verification at checkout and/or at the time of delivery.

3. Products and Compliance

All products sold through PyroApex Pro comply with Consumer Product Safety Commission (CPSC) standards as set forth in 16 C.F.R. Part 1507. All fireworks products carry the required cautionary labeling in accordance with 16 C.F.R. § 1500.14(b)(7). We do not sell any items that have been banned by the CPSC.

4. State Legality and Geographic Responsibility

All merchandise is sold and shipped on the representation of the buyer that the merchandise will be used in accordance with the laws of the state, city, and county of destination. It is the purchaser's sole responsibility to confirm compliance with all applicable local, state, and federal laws regarding the possession, transportation, storage, sale, and use of fireworks before placing an order. We assume no liability for misuse, illegal sale, or transportation by the customer. We are not responsible for fireworks items seized by authorities in locations where they are not permitted.

5. Permits and Licenses

It is the purchaser's sole responsibility to obtain any and all permits, licenses, or other authorizations required for the purchase, possession, transportation, storage, sale, or use of fireworks in your jurisdiction. The presence of any product on this website does not constitute a representation that such product is legal in the buyer's location.

6. Hazmat Shipping

Fireworks are classified as Division 1.4G explosives under the U.S. Department of Transportation (DOT) regulations (49 CFR). As such, the following shipping restrictions apply:

• All fireworks shipments are transported only via licensed hazmat freight carriers
• An adult aged 18 or older must be present to sign for delivery
• Delivery to PO boxes is not available
• Minimum freight charges may apply
• The following carriers are prohibited from shipping fireworks: USPS, UPS, FedEx Ground/Home Delivery, and DHL

7. Pricing and Payment

• All prices are listed in U.S. Dollars (USD)
• We reserve the right to correct pricing errors and to refuse or cancel any orders placed at an incorrect price
• Sales tax is calculated on a destination basis for retail customers; wholesale customers are exempt with proper documentation
• A binding contract is formed upon shipment of your order, not upon order placement

8. Returns and Refunds

ALL SALES ARE FINAL.

Due to DOT hazmat classification, fireworks cannot be returned under any circumstances. No refunds or exchanges will be issued.

Exception for damaged goods: Any damage must be documented on the Bill of Lading with the driver present before signing for delivery. Photographic evidence is required. All damage claims must be reported within 10 days of delivery.

Refused shipments: If a shipment is refused by the recipient, the customer is responsible for all return freight charges plus a 15% restocking fee.

9. Wholesale Account Terms

• Licensed dealers must provide valid state and local permits to establish a wholesale account
• Wholesale customers must maintain current licensing at all times
• Customers must notify PyroApex Pro immediately of any changes to their license status
• Accounts may be terminated for non-compliance with licensing requirements

10. User Accounts

You are required to provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms.

11. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of PyroApex Pro / Digital Drywood LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive license for personal, non-commercial use only. Scraping, reproduction, or redistribution of any content without express written permission is prohibited.

12. Safety and Proper Use

Fireworks are inherently dangerous. By purchasing from PyroApex Pro, you acknowledge and accept the risks associated with fireworks. You agree to:

• Read and follow all manufacturer instructions and warning labels
• Store fireworks in a cool, dry place away from heat sources and open flame
• Never allow children to handle or ignite fireworks
• Comply with all local restrictions regarding the use of fireworks

13. Disclaimer of Warranties

All products are sold "as is" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law, the total liability of PyroApex Pro and Digital Drywood LLC shall be limited to the amount paid by the customer for the specific product giving rise to the claim. In no event shall PyroApex Pro , Digital Drywood LLC, or their affiliates be liable for any consequential, incidental, special, exemplary, or punitive damages arising out of or in connection with the use of our products or services.

15. Indemnification

You agree to indemnify and hold harmless PyroApex Pro , Digital Drywood LLC, and their affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: your breach of these terms, your violation of any applicable law, your misuse of any products purchased, or your ordering of products to jurisdictions where such products are prohibited.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Kansas. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Bourbon County, Kansas.

17. Changes to Terms

PyroApex Pro reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this website. Your continued use of the website following any changes constitutes your acceptance of the revised terms.
